In Nevada, you generally have two years from the date of the accident to file a personal injury lawsuit for a crash-related injury, and three years to file for property damage (NRS 11.190). If a loved one died in the crash, the wrongful death deadline is also generally two years. Miss the deadline and the court can permanently bar your claim — no matter how clearly the other driver was at fault. A few narrow exceptions can shorten or extend the clock, so the safest move is to speak with an attorney as early as possible. Even if you're still negotiating with an insurer, that two-year filing deadline keeps running.
An insurance claim is the out-of-court process: we notify the at-fault party's insurer, document your injuries and losses, and negotiate a settlement. Most Nevada cases resolve here, without ever going to court. A lawsuit is the formal court case we file when the insurer won't offer a fair amount, disputes who was at fault, drags its feet, or when the filing deadline is approaching. Filing suit opens up formal deadlines, evidence exchange (discovery), and — if needed — a trial or arbitration. Filing a lawsuit doesn't mean you'll end up in front of a jury; many suits still settle once the insurer sees we're prepared to try the case. We always aim for the fastest fair resolution, and file suit strategically when that's what it takes.
You may still recover. Nevada uses a 'modified comparative negligence' rule (NRS 41.141): as long as you were 50% or less at fault, you can still recover damages — reduced by your share of the blame. For example, if you're found 20% at fault on a $100,000 case, you'd recover $80,000. The catch is the '51% bar': if you're found 51% or more at fault, you recover nothing. That's exactly why insurers try to pin fault on you — and why having an attorney build the liability picture matters so much.
Be careful. The at-fault driver's insurer may sound friendly, but their goal is to pay you as little as possible. You are not required to give a recorded statement, and early statements are often used to minimize or deny your claim. It's usually best to let us communicate with the insurer on your behalf. You should promptly notify your own insurer that an accident occurred, but you don't have to accept a quick settlement offer — those first offers are almost always far below what your claim is worth.

Nevada law lets you recover both economic damages (bills, wages) and non-economic damages (pain and suffering).
